General Conditions

1.1 – Welcome to Booket Now. These Terms and Conditions (the “Terms”, the “Terms and Conditions”) together with all updates, supplements, additional terms, and all rules and policies, constitute the legal agreement (“Agreement”) between the Customer (“User”, “you”) and Booket Now including its mobile application and website (“Booket Now”, “Booket Now platform”, the “platform”, “we”, “us”, “our”). Booket Now trade name is owned by BOOKET NOW EVENTS Limited Liability Company, commercial registration number [number], with registered address [address]. These Terms and Conditions govern your use of our platform for any of its related services (the “Services”) including the following:

i. The use of our platform to purchase tickets, reservations, bookings, or passes of any kind (“Ticket(s)”), on and for any date and time to any event, match, concert, show, conference, promotion, or other activity, at any location and for any purpose (“Event(s)”) organized, hosted, facilitated, sponsored and advertised by any entity (“Event Organizer”);

ii. The use of our platform to peruse ongoing and upcoming events in the State of Qatar and other GCC countries/countries in the Middle Eastern region.

1.2 – By using any or all of our services, you are accepting these Terms and Conditions and entering into a legal and binding Agreement with Booket Now. If you do not agree with these Terms and Conditions, please do not use the platform.

1.3 – We reserve the right to modify or amend these Terms and Conditions from time to time without prior notice, and the revised version will be effective when posted on the platform or sent to the email provided by you when you created an account with Booket Now or otherwise made available to you. The use of our Services after the notification of amendments to these Terms and Conditions means that you irrevocably accept these amendments. The amended Terms and Conditions shall supersede any prior agreements or arrangements we may have with you.

1.4 - You are entitled to stop using our Services at any time, and we may terminate this Agreement or your use of any Services, or generally cease offering or deny access to any portion of the Services, at any time at our sole discretion.

Account Registration

2.1 – To use our Services you must create an account with Booket Now.

2.2 – When creating your account, you must:

- Provide your name, email, phone number and address.

- Provide true, accurate, current and complete information about yourself.

- Create a username and a strong password.

2.3 – If you provide any information that is inaccurate, not current, incomplete, or Booket Now has reasonable grounds to suspect that such information is untrue, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.

2.4 - You are solely responsible to maintain and promptly update the information made available at the moment of creation of the account, in order to keep it true, accurate, current and complete.

2.5 - Your account is personal and not intended for use by anyone else. You should not share your account information or your username and password with any third party or permit any third party to logon to the Booket Now platform using your account information. You are responsible for the security and confidentiality of your username, password and ultimately your account. Furthermore, you are responsible for any and all activities that occur under your account.

2.6 - We have the right to provide your account details (such as but not limited to, billing, account content or usage records and any related information) if required by law and to protect our rights, customers and/or business.

2.7 – By opening an account with Booket Now you agree that we have the right to suspend, disable or cancel your account as may be necessary, for reasons such as but not limited to:

- ensuring the legal use of the platform, including, without limitation, to prevent any fraud, to perform any risk assessment or investigation;

- customer support associated reasons;

- ensuring compliance with this Agreement;

- complying with applicable law or the order of a court, law enforcement organization, request from any governmental body; or

- as otherwise provided in these Terms and Conditions.

Privacy

3.1 - By using the Services, you consent to the collection, use, disclosure and handling of your personal information as detailed in our Privacy Policy [insert link].

Rules of Conduct

4. 1 - You agree that you are only authorized to visit, view, and retain a copy of pages of Booket Now’s platform for your own personal use, and that you shall not duplicate, download, publish, modify, or otherwise distribute the material on this site for any purpose other than to review an event and its promotional information, for personal use, or to purchase tickets for personal use, unless otherwise specifically authorized by Booket Now to do so.

4.2 - You agree not to engage in illegal and/or unauthorized uses of the Booket Now platform, including but not limited to the following:

- To abuse, harass, threaten, impersonate, or intimidate any person;

- To communicate with Booket Now representatives or other users in an abusive or offensive manner;

- For any purpose that is not permitted under the laws of the State of Qatar;

- To post or transmit, or cause to be posted or transmitted, any communication designed or intended to obtain password, account, or private information from any Booket Now user.

4.3 - You agree that you may only use the Booket Now platform for its intended purpose.

4.5 - By using the Services, you submit that you are over the age of 18 years old.

Violation of these Terms and Conditions

5.1 - If you violate these Terms or violate the rights of Booket Now, any other user, or the law, Booket Now may terminate your use of the Booket Now platform, prevent you from making all future bookings using the Booket Now platform, and/or take legal action against you.

5.2 - Booket Now may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. This is in addition to any other uses permitted under or Privacy Policy.

5.3 - Booket Now is not required to provide any refund to you if you are terminated as a user because you have violated these Terms, except as expressly set out in these Terms.

Account Termination Information:

We may terminate your account:

- If you violate these Terms and Conditions;

- If you are involved in the illegal re-sale of tickets;

- If you violate the laws of the State of Qatar;

- For any reason, at our sole discretion;

Disclaimers

7.1 - Booket Now cannot ensure that the files you download from the Booket Now platform will be free of viruses, contamination, or destructive features although Booket Now will take steps consistent with industry practice to protect against this occurring.

7.2 - Booket Now makes no guarantee of any specific result from use of the Booket Now platform.

7.3 - Booket Now is not responsible for the enjoyment of the user as a result of the Services nor is Booket Now responsible for ensuring the user has picked satisfactory goods/services for their specific need.

Links & Search Results

8.1- The Booket Now platform may include links posted by the Event Organizer or automatically produce search results that reference or link to third party sites. Booket Now cannot guarantee, represent, or warrant that the content contained in third party sites is accurate, legal, and/or inoffensive.

8.2 - Booket Now does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise affect your mobile device in a harmful or damaging way.

8.3 - By using the Booket Now platform to link to another site, you agree and understand that you may not make any claim against Booket Now for any damages or losses, whatsoever, resulting from your use of the Booket Now platform to obtain search results or to link to another site.

8.4 - If you have a problem with a link from the Booket Now platform, please notify us at [contact] and we will investigate and take actions we deem appropriate at our sole discretion.

Limitation of Liability

9.1 - In no event will Booket Now be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages.

9.2 - In no event will Booket Now be liable to you for the conduct of third parties, including Event Organizers or operators of external sites.

9.3 - In no event will Booket Now be liable to you for the conduct of other users.

9.4 - In no event shall Booket Now be liable to you for any damages, losses, and/or causes of action arising from the Terms.

Indemnity

10.1 - You agree to indemnify and hold Booket Now and its parent company, subsidiaries, affiliates, employees, and agents harmless from any losses, costs, liabilities and expenses relating to or arising out of:

your use of our Services;

your violation of these Terms;

your violation of any rights of another party;

your violation of any applicable laws, rules, or regulations;

any disputes or claims between you and any other user.

10.2 - You agree that the provisions in this section will survive any termination of your account, the Terms, or your access to the Booket Now platform.

Delivery, Collection, and Printing of Tickets

11.1 - Through the Booket Now platform, the Event Organizer may elect to offer one or more of the following delivery options for your ticket order.

- By Ticket Wallet: the Booket Now platform contains a Ticket Wallet feature that will contain an electronic version of your Ticket(s) when possible.

- By email/e-ticket: the Booket Now platform allows you to provide your email address and will attempt to deliver your e-ticket to that email address.

If you do not receive your e-ticket, please contact Booket Now by email at [email] at least 48 hours before the scheduled event.

- “At the door”: The delivery of Ticket(s) purchased through Booket Now using the “At the door” option is the sole responsibility of the Event Organizer.

- By ground mail: The delivery of Ticket(s) purchased through Booket Now using the ground mail option is the sole responsibility of the Event Organizer.

11.2 - Delivery of tickets is the sole responsibility of the Event Organizer, unless Booket Now has undertaken to provide this service to the Event Organizer.

PURCHASE POLICY

12.1 - General

12.1.1- Booket Now operates a mobile application and website where you can purchase primary Tickets to Events allocated to us directly by Event Organizers for sale by Booket Now. We sell these Tickets on behalf of the Event Organizers. Please note that we are not responsible for organizing or delivering the events themselves.

12.1.2 - This “Purchase Policy” section of the Terms and Conditions sets out the terms and conditions applicable to purchases of Tickets from us.

12.1.3 - This Purchase Policy does not apply to purchases or sales of Tickets originally purchased on the Booket Now platform but subsequently re-sold outside the Booket Now platform.

12.1.4 – Your contract for purchase starts once we have confirmed your order and ends immediately after completion of the event for which you have purchased Ticket(s).

12.2 – Ticket Restrictions

12.2.1 - We sell Tickets as and when they are allocated to us by Event Organizers and in accordance with their instructions. The number and type of Tickets allocated for sale by us vary on an event-to-event basis. We do not control Ticket inventory or availability.

12.2.2 - Within those limitations, Booket Now prohibits users from purchasing a number of tickets exceeding any number per individual transaction/per event per user as determined by the Event Organizer(s) of the relevant Event(s).

12.2.3 – You are not entitled to purchase any Ticket(s) as a trader acting in the course of business with the intention of reselling your Ticket(s) for profit unless formal written permission is given by Booket Now and the relevant Event Organizer in advance. If we discover or have reason to believe that you have purchased and intended to resell or have sold Ticket(s) in breach of this clause, we reserve the right to cancel your Ticket(s) and terminate your account without notice.

12.2.4 – You may not resell or transfer your Ticket(s) if prohibited by law. In addition, Event Organizers may restrict or prohibit resale or transfer of tickets for some events. Any resale or transfer (or attempted resale or transfer) of a Ticket in breach of the applicable law or any restrictions or prohibition imposed by an Event Organizer is grounds for cancellation of that Ticket.

12.2.5 – Tickets purchased from Booket Now may not be used for advertising, promotions, contests, or other such similar commercial gain, and/or be combined with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create a package for sale or other distribution, unless formal written permission is given by us and the relevant Event Organizer in advance.

12.2.6 – Booket Now will not be responsible for any Ticket(s) that are lost, stolen, damaged or destroyed following receipt or collection by you.

12.2.7 – You acknowledge that lost, stolen, damaged, or destroyed Ticket(s) may not be replaced where policies set by an Event Organizer prohibit us from issuing replacement tickets. If we are able to issue replacement Tickets, we may charge you an administration fee.

12.2.8 – Where your Ticket(s) are for allocated seats, you have a right only to seats of value corresponding to that stated on the Ticket. Booket Now or the relevant Event Organizer or venue reserve the right, before, during and after the event, or provide alternative seats to those initially allocated to you or specified on the Ticket.

12.3 - Event Cancelations and Alterations

12.3.1 - If an event is cancelled, rescheduled, or materially altered, Booket Now will use reasonable endeavors to notify you once we have received the relevant information and authorization from the Event Organizer. However, we cannot guarantee that you will be informed of such cancellation, rescheduling or alteration before the date of the event. It is your responsibility to ascertain whether an event has been cancelled, rescheduled or altered and the date and time of any rescheduled event.

12.3.2 – Cancellation: If an event for which you have purchased Ticket(s) is cancelled in full (and not rescheduled), your order will be cancelled, and you will be refunded the Sale Price of your Ticket(s) (Service Charges and Order Processing Fees may be non-refundable). If you have purchased Ticket(s) for an event that takes place over several days and one or more days (but not all days) are cancelled, you may only be offered a proportionate partial refund.

12.3.3 – Rescheduling: If an event for which you have purchased Ticket(s) is rescheduled, Ticket(s) will usually be valid for the new date (or you will be offered Ticket(s) of a value corresponding with your original Ticket(s) for the rescheduled event, subject to availability). If you notify us within the specified deadline that you are unable to attend the rescheduled event, you will be able to cancel your order and obtain a refund of the Sale Price of your Ticket(s). If we do not specify a deadline, the deadline by default will be 48 hours before the date of the rescheduled event. Failure to notify us by the applicable deadline that you are unable to attend the rescheduled event will be deemed to be a reconfirmation of your order for Ticket(s) for the rescheduled event, and you will not be able to claim a refund.

12.3.4 – For the purposes of this Purchase Policy, a “material alteration” is a change (other than rescheduling) which, in our and the relevant Event Organizer’s reasonable opinion, makes the event materially different to the event that the user, taken generally, could reasonably expect.

12.3.5 – Material Alteration: If an event for which you have purchased Ticket(s) is “materially altered” (as defined in Clause 12.3.4), Ticket(s) will usually be valid for the altered event (or you will be offered Ticket(s) of a value corresponding with your original Ticket(s) for the altered event, subject to availability). If you notify us within 48 hours or any other specified deadline of the altered event that you do not wish to attend, you will be able to cancel your order and obtain a refund of the Sale Price of your Ticket(s). Failure to notify us within 48 hours or any other specified deadline that you do not wish to attend the altered event will be deemed a reconfirmation of your order for Ticket(s) for the altered event, and you will not be able to claim a refund.

12.4 – Returns

12.4.1 – Unless otherwise indicated when you purchase the Ticket(s), you may return any Ticket(s) eligible for return pursuant to the Booket Now policy to Booket Now in exchange for a promotional code equal to the original price you paid for your Ticket(s), including all service fees and processing charges, at any time up to 72 hours prior to the scheduled start time of your event, provided you agree with the following:

- (a) You return your Ticket(s) in accordance with the instructions provided to you by Booket Now prior to receiving the promotional code;

- (b) You will not resell the Ticket(s) and doing so will forfeit your eligibility to return your Ticket(s).

- (c) The promotional code shall expire twelve (12) months from the date of issue and is only eligible for one-time use, meaning that if you use the promotional code on a purchase that is less than the value of the promotional code, you forfeit the remaining balance.

- (d) Additional terms may apply to your event as specified at the time you purchase your Ticket(s).

12.5 – Refunds

12.5.1 – To claim a refund under Clause 12.3.2, 12.3.3, 12.3.5, or 12.4, please following the instructions we provide to you or apply in email form to [contact]. Where applicable and instructed to do so, you must return to us your unused Ticket(s) and comply with any other instructions from Booket Now.

12.5.2 – Refunds will be made using the same means of payment as you used for the initial purchase.

12.6 – Payment Methods

12.6.1 – Accepted methods of payment include Visa, MasterCard, and bank transfer.

12.6.2 – All purchases are subject to credit or debit card verification, other security checks, and collection of payment by Booket Now. Your order may be cancelled if it has not passed our verification process or if payment is not received in full.

12.6.3 – If you do not receive an order confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your Booket Now account or using our contact information whether or not your order has been placed. Booket Now will not be responsible for any costs or losses you incur if you assume that an order was or was not placed because you failed to receive an order confirmation.

12.7 – Prices, Fees & Charges

12.7.1 – All prices for Tickets offered for sale from us constitute the Sale Price of the item (“Sale Price”).

12.7.2 – Whilst Booket Now tries to ensure that all advertised prices are accurate, errors may occur. If we discover an error in the price of any Ticket(s) you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price, in which case we will credit or debit you as applicable, or cancelling your order, in which case you will receive a full refund.

12.7.3 – In many circumstances, Ticket prices are set at the time of the initial on-sale and stay the same until the event. However, some Tickets are “market-priced”, and so Sale Prices may increase or decrease at any time, based on demand. You will not be entitled to a refund or credit if the Sale Price you paid for a Ticket was at any time before you purchased your Ticket less than the Sale Price you paid, or if the Sale Price of any other Tickets to the relevant event is/are subsequently reduced after you purchase your Ticket(s).

Disputes

13.1 - All or any disputes arising out of or related to these Terms and Conditions including the interpretation and validity of the Terms thereof and the respective rights and obligations of the Parties shall be settled by the Qatari Civil Courts.
